REGULATIONS OF THE INTERNET SHOP as of 25.03.2020.
I. Definitions.
The terms used in the Regulations shall mean:
1. Customer - a natural person, a legal person or an organizational unit that is not a legal person, to which special regulations grant legal capacity, who makes an Order from the Store;
2. Seller - Małgorzata Gancarz, conducting, in accordance with Article 5(1) of the Act of March 6, 2018. - Entrepreneur Law, an unregistered business based at: Pallotyńska 1 Street, 27-600 Sandomierz, who sells goods in the Store.
3. the Civil Code - the Act of April 23, 1964 (Journal of Laws No. 16, item 93 as amended);
4. Rules and Regulations - these Rules and Regulations for the provision of electronic sales services in the online store www.anibeeeanimeee.pl;
5. Online Store (Store) - the Internet service available at www.anibeeeanimeee.pl, through which the Customer may, in particular, place Orders;
6. Merchandise - products presented in the Online Store;
7. Contract of sale - a contract of sale of Goods within the meaning of the Civil Code, concluded between Małgorzata Gancarz, conducting, in accordance with Article 5(1) of the Act of March 6, 2018. - Entrepreneurs' Law, an unregistered business based at: Pallotinska 1 Street, 27-600 Sandomierz and the Customer, concluded using the Store's online service;
8. The Consumer Rights Act - the Act of May 30, 2014 on consumer rights (Journal of Laws of 2014, item 827);
9. The Act on Provision of Electronic Services - the Act of July 18, 2002 on Provision of Electronic Services (Journal of Laws No. 144, Item 1204 as amended);
10. Order - a declaration of will of the Customer, aiming directly at the conclusion of the Sales Agreement, specifying in particular the type and number of Goods.
II. General Provisions.
2.1 These Regulations set out the rules for the use of the online store available at www.anibeeeanimeee.pl.
2.2 These Regulations are the regulations referred to in Article 8 of the Act on electronic provision of services.
2.3 The online store, operating at www.anibeeeanimeee.pl, owned by Małgorzata Gancarz, who conducts, in accordance with Article 5(1) of the Act of March 6, 2018. - Entrepreneurs' Law, an unregistered activity based at: 1 Pallotinska Street, 27-600 Sandomierz,
2.4 These Regulations define in particular:
(a) rules for registration and use of an account within the online store;
b) terms and conditions for making electronic reservations of products available within the online store;
c) terms and conditions for placing Electronic Orders within the online store;
d) the principles of concluding Sales Contracts using the services provided as part of the Online Store.
2.5 The use of the online store is possible through devices communicating with the Internet (computer, telephone), using a web browser.
2.6 In order to use the online store, the Customer shall, on his own, obtain access to a computer workstation or a terminal device, with access to the Internet.
2.7 In accordance with applicable laws, the Seller reserves the right to limit the provision of services through the Store int
2.8. Customers may access these Regulations at any time through the link provided on the home page of www.anibeeeanimeee.pl and download and print them.
2.9 Information about the Goods provided on the Store's website, in particular their descriptions, technical and performance parameters and prices, constitute an invitation to conclude a contract, as defined by Article 71 of the Civil Code.
III. Rules of use of the Online Store.
3.1 To start using the Online Store, you must register with it.
3.2 Registration takes place by completing and accepting a registration form, made available on one of the pages of the Store.
3.3 The condition of registration is to agree to the content of the Terms and Conditions and provide the necessary personal data.
3.4. The Seller may deprive the Customer of the right to use the Online Store, as well as may restrict the Customer's access to part or all of the Online Store's resources, with immediate effect, if the Customer violates the Terms and Conditions, and in particular if the Customer:
(a) provided during registration in the Internet store data that is untrue, inaccurate or outdated, misleading or violating the rights of third parties,
b) has committed, through the online store, a violation of the personal rights of third parties, in particular the personal rights of other customers of the online store,
c) will engage in other behavior that will be considered by the Seller as inconsistent with applicable laws or general rules of Internet use or detrimental to the good name of the Seller.
3.5 A person who has been deprived of the right to use the online store may not register again without the prior consent of the Seller.
3.6 In order to ensure the security of the transmission of messages and data in connection with the services provided on the Website, the Online Store shall take technical and organizational measures appropriate to the degree of security threat to the services provided, in particular, measures to prevent unauthorized persons from obtaining and modifying personal data transmitted on the Internet.
3.7 In particular, the Customer shall:
(a) not to provide or transmit content prohibited by law, e.g. content that promotes violence, defamatory content or content that violates the personal rights and other rights of third parties,
b) use the Online Store in a manner that does not interfere with its operation, in particular through the use of specific software or devices,
c) not to undertake activities such as: sending or posting unsolicited commercial information (spam) within the scope of the Online Store,
d) use the Online Store in a manner that is not burdensome to other customers and Małgorzata Gancarz,
e) use any content placed within the scope of the Internet Shop only for own personal use,
f) use the Online Store in a manner consistent with the provisions of the law in force on the territory of the Republic of Poland, the provisions of the Rules, as well as with the general principles of Internet use.
IV. Procedure for concluding a Sales Agreement.
4.1 In order to conclude a Sales Agreement through the Online Store, the Customer should visit the website www.anibeeeanimeee.pl, make a selection of the product, taking further technical actions based on the messages displayed to the Customer and the information available on the website.
4.2.The Customer's selection of the ordered Goods is made by adding them to the shopping cart.
4.3.In the course of placing an Order - until the moment of pressing the "Order" button. - The Customer has the possibility to modify the entered data and in the selection of the Goods. For this purpose, follow the messages displayed to the Customer and the information available on the site.
4.4 After the Customer using the Online Store has provided all the necessary data, a summary of the submitted Order will be displayed. The summary of the submitted Order will contain information regarding:
(a) the subject of the Order,
b) unit and total price of the ordered products or services, including delivery costs and additional costs (if any),
c) the selected method of payment,
d) the selected method of delivery,
4.5 In order to send an Order it is necessary to accept the content of the Regulations, provide the necessary personal data and press the button "I accept the Regulations".
4.6 The Customer's sending of the Order constitutes a statement of intent to conclude a Sales Contract with the Seller, in accordance with the content of the Regulations. 1
4.7 After placing an Order, the Customer shall receive an e-mail message entitled "ORDER CONFIRMATION No. ...", containing the final confirmation of all material elements of the Order.
4.8 The Contract shall be considered concluded at the moment the Customer receives the e-mail message referred to above.
4.9. The Contract of Sale shall be concluded in the Polish language, with the content consistent with the Regulations.
V. Delivery.
5.1 Delivery of the Goods shall be limited to the territory of the Republic of Poland and shall be made to the address indicated by the Customer when placing the Order.
5.2 Delivery of the ordered Goods shall be made by DPD courier service, by Polish Post. There is also the possibility of personal collection. Delivery costs are available at [https://anibeeeanimeee.pl/pl/i/Czas-i-koszt-dostawy/4]. In addition, the cost of delivery will be indicated at the time of placing the Order.
5.3 The delivery period is from 2 to 5 working days counting from the day of sending the Order by the Customer.
5.4 Customers may access these Terms and Conditions at any time through the link provided on the home page of the website [https://anibeeeanimeee.pl/pl/i/Regulamin/3], and download and make a printout. Recording, securing, making available and confirming to the Customer the significant provisions of the Agreement for sale of Goods shall be done by sending to the Customer at the e-mail address provided and by attaching to the parcel containing the Goods a printout of the confirmation, the Order specification and the pro forma invoice.
VI. Prices and payment methods.
6.1. The prices of the Goods are quoted in Polish zloty and include all components, including VAT (distinguished by the rate), customs duties and any other components.
6.2 The Customer shall have the option to pay the price:
(a) by bank transfer to the bank account number [42 1240 2786 1111 0010 4686 4869].
VII. Right of withdrawal.
You have the right to withdraw from this contract within 14 days without giving any reason.
The withdrawal period expires after 14 days from the date of receipt of the shipment.
To exercise your right of withdrawal, you must inform about your decision to withdraw from this contract by an unequivocal statement - the completed form should be sent by e-mail to: anibeeeanimeee@gmail.com
A sample withdrawal form is included in Appendix No. 2 to the Consumer Rights Act.
To meet the deadline for withdrawal from the contract, it is sufficient for you to send information on the exercise of your right of withdrawal before the deadline for withdrawal.
Send the returned item in its original packaging, including all accessories, immediately to an address other than the address of the company's registered office (the address will be provided in the e-mail confirming receipt of the complaint), but no later than 14 days from the day on which you withdrew from the contract.
The returned article is sent at the expense of the buyer.
We will return the payment no later than 14 days from the day we receive your statement of withdrawal from the contract. We may withhold reimbursement until we receive the item or until you provide us with proof of its return, whichever event occurs first.
Effects of withdrawal from the contract
If you withdraw from this contract, you will be refunded the cost of the purchased item, no later than 14 days from the day we are informed of your decision to exercise your right to withdraw from this contract. We will refund the payment using the same means of payment that you used in the original transaction, unless you have expressly agreed otherwise.
VIII. Complaints about Goods
8.1 Małgorzata Gancarz, as a seller, is liable to the Customer who is a consumer within the meaning of Article 22 of the Civil Code, under warranty for defects to the extent specified in the Civil Code, in particular Article 556 and Article 556 - 556 of the Civil Code.
8.2 Complaints, arising from violation of the Customer's rights guaranteed by law, or under these Regulations, should be addressed to anibeeeanimeee@gmail.com. Małgorzata Gancarz undertakes to consider each complaint within 14 days, and if this is not possible, to inform the Client within this period when the complaint will be considered.
IX. Complaints regarding the provision of services by electronic means
9.1. Małgorzata Gancarz shall take steps to ensure the fully correct operation of the Store, to the extent that results from current technical knowledge, and undertakes to remove any irregularities reported by the Customers within a reasonable period of time.
9.2 The Customer is obliged to immediately notify Małgorzata Gancarz of any irregularities or interruptions in the functioning of the Online Store service.
9.3 The irregularities related to the functioning of the Store, the Customer can report them by e-mail to: anibeeeanimeee@gmail.com or by using the contact form.
9.4 In a complaint, the Customer should provide: name and surname, address email, type and date of occurrence of irregularities related to the functioning of the Store.
9.5. Małgorzata Gancarz undertakes to consider each complaint within 14 days, and if this is not possible, to inform the Customer within this period when the complaint will be considered.
X. Final provisions
10.1 Settlement of potential disputes arising between Małgorzata Gancarz and the Customer, who is a consumer within the meaning of Article 22[1] of the Civil Code, shall be submitted to the competent courts in accordance with the provisions of the relevant provisions of the Civil Procedure Code.
10.2 In matters not regulated by these Terms and Conditions, the provisions of the Civil Code, the provisions of the Act on rendering electronic services and other relevant provisions of Polish law shall apply.
